DEMOLITION OF BUILDINGS
[GPDO Part 31 Class A]
Planning permission is not
required for:-
Any
building operation consisting of the demolition of a building"
Except where:
- the building has been rendered unsafe or
uninhabitable by the action or inaction of any person having an interest
in the land on which the building stands and
- it is practicable to secure safety or health
by works of repair or works for affording temporary support.
And subject to the following
conditions:
- in cases where it is urgently necessary to carry
out immediate demolition in the interests of health and safety, the
developer must send a written justification to the Council at the
earliest opportunity.
- In other cases the developer must first seek
a determination from the Council as to whether the prior approval of the
Council is required concerning the method of demolition and the
subsequent restoration of the site.
DETERMINATION PROCEDURE
Special forms and notices may
be available for this purpose from the planning office.
- You must apply to the Council in writing for
a determination, including in your application a written description of
the proposed development (demolition).
- A site notice must be posted on or near the
land containing the building for demolition. This must be in position for
at least 21 days out of a period of 28 days starting from the date on
which you submitted the determination request.
- If the notice is removed or defaced etc
before the end of the 21 day period and you have taken reasonable steps
to protect it and to comply with the requirements, (perhaps by replacing
it with a copy) then you will be treated as having complied with the
requirements.
- The demolition may not commence until one of
the following has occurred:-
- you have received a written determination
from the Council that prior approval is not required. Or
- the 28 days have expired and the Council
have made no determination.
- The demolition shall be carried out in
accordance with any prior approval requirements laid down by the Council
or in accordance with any details you submitted in your application for a
determination.
- The works must be carried out within a
period of 5 years from the date of any Council approval or the date when
the information was first provided to the Council, whichever applies.
There are a number of
additional qualifications that apply to this section.

Planning permission is not
required for:
Any
building operation consisting of the demolition of the whole or any part of any
gate, fence, wall or other means of enclosure.
There are no other conditions
or limitation s relating to this section.
