ENFORCEMENT NOTICES
1. The notice will specify the steps
that you MUST take in order to comply with the notice and remedy the breach.
You can comply with the various requirements to overcome the
Council's concern before the notice takes effect. This does not mean the Notice
will not take effect, but it will have been complied with.
The notice will remain in force (unless revoked).
You should discuss remedial works with the Enforcement Officer and
obtain his confirmation that the alleged breach has been properly remedied. An
extension of time may be sought in order to properly comply.
2. The notice will also set out your
rights to appeal against the Enforcement Notice if you believe the Council is
incorrect in issuing the notice.
You
should give careful consideration to the reasons for the notice being issued.
Appeals should not be treated lightly nor used as a delaying tactic. Costs and
other sanctions do apply.
If you decide that an appeal is required, make the appeal
well before the date on which the notice is due to take effect. A late appeal
will not be valid.
