PERMITTED DEVELOPMENT RIGHTS

DOMESTIC

PORCHES, PATIOS, PATHS & HARDSTANDINGS

Porches require planning permission if they are:

    1. More than 3 square metres in floor area (measured externally).
    2. Would be taller than 3m from the highest adjoining ground level.
    3. Would be within 2m of a 'highway' boundary.

Patios will only require planning permission if they are to be used for non-domestic purpose. There is no size limit to the extent of a patio.

Paths will only require planning permission if in some way they are not to be used for domestic purposes.

Hardstandings will only require planning permission if they are to be used for non- domestic purposes.

DRIVEWAYS

If a new driveway is proposed which crosses a pavement or grass verge you should consult the HIGHWAYS DEPARTMENT of your local Council for information.

Planning permission will be required if you intend making a new or wider access to a trunk road or classified road. Check with the Highways Department.

FENCES & WALLS

Planning permission will be required if :-

  • The fence or wall is next to a 'highway' and will be over 1 metre in height or,
  • Will be over 2 metres in height anywhere else.
  • The fence is within the grounds of a Listed Building.
  • Planning conditions prevent the erection of fences (eg open-plan estates).
  • The property is within an area covered by an Article 4 Direction.

 

 A FENCE can include hedges and trees, earth mounds and other means of enclosure.

Where a fence is to be erected which could affect sight-lines or traffic safety in general, it is advisable to check with the Council even though planning permission may not be necessary.

TV, SATELLITE & RADIO AERIALS

Until recently planning permission has not been required for the installation of normal domestic TV and radio aerials. The Government have recently issued Circular 10/05 PERMITTED DEVELOPMENT RIGHTS FOR ANTENNAS which provides more detailed guidance on the installation of aerials. [Link to Circular]

Planning permission for satellite dishes may be required in certain circumstances. The Department of Environment Transport and the Regions produce a helpful booklet setting out not only the planning requirements, but also providing helpful tips on appropriate siting of dishes in the interests of the environment.

Your planning department may ask you to re-site the dish, even if planning permission is not required, if they think the dish is poorly sited and could be located in a better position.

Installation on Houses

Planning permission is required if you live in a Conservation Area, a National Park, an Area of Outstanding Natural Beauty or the Broads.

Listed Building Consent may also be required for Listed properties.

You will not need planning permission if:-

  • There is only one dish on the house or in the garden
  • The dish is no bigger than 90cm
  • The dish will not protrude above the highest part of the roof (excluding chimney stacks)
  • If the dish is installed on a chimney, it is no bigger than 45cm and not higher than the highest part of the stack.

Installation on a Block of Flats over 15m high (about 5 storeys)

Planning permission is required if you live in a Conservation Area, a National Park, an Area of Outstanding Natural Beauty or the Broads.

You will not need planning permission if:-

  • There are no more than two dishes on the whole building
  • The dish is no bigger than 1.3m

Installation on a Small Block of Flats (below 15m) or Commercial Premises

Planning permission is required if :-

  • You live in a Conservation Area, a National Park, an Area of Outstanding Natural Beauty or the Broads.
  • If there is already one dish on the building as a whole.

You will not need planning permission if :-

  • The dish is no bigger than 90cm (45cm if on a chimney)
  • The dish is not on a chimney, wall or roof slope fronting a road or public footpath.

 If you are a tenant or leaseholder you may need landlords permission to erect a dish. Check to see if permission has already been granted or if there is a shared dish available.

DECORATION, MAINTENANCE AND REPAIR

Planning permission is not required for :-

  • General repairs and maintenance
  • Internal alterations
  • Painting your house
  • Replacing windows
  • Putting in new windows, rooflights, skylights etc (Bay windows will be treated as an extension to the house) [Go to Extensions]
  • Re-roofing without any extensions
  • Installation of solar panels which do not significantly project above the roof slope.

  Planning permission may be required where planning conditions or an Article 4 Direction restrict your permitted development rights.

Any significant works (whether internal or external) to a Listed Building will require Listed Building Consent.

DEMOLITION

Planning permission is not required except in certain circumstances. However, it is important to note that you cannot rebuild on the cleared site without the benefit of a planning permission. There is no automatic right to a new consent.

Listed Buildings do not need a planning permission for demolition but you DO need Listed Building Consent.

Similarly, buildings in a Conservation Area will need a Conservation Area Consent.

You do not need permission to demolish:-

  • A building of less than 50m³ such as a shed or garage.
  • Where demolition is required urgently for public health or safety reasons.
  • As part of a redevelopment scheme for which planning permission has been granted.
  • If demolition is required by other statutory authority.
  • Walls, fences, hedges etc may also be removed.

  For any other proposed demolition you should consult your Council to agree the method of demolition and any reinstatement of the cleared site.

You should submit a "Prior Approval Application" and obtain the Councils formal approval of your proposals.

CLADDING

You will only need planning permission for the cladding of your house if you live within a Conservation Area, National Park, Area of Outstanding Natural Beauty or the Broads.

Listed Building Consent may be required for Listed properties.

STORAGE TANKS

Planning permission is not normally required in circumstances where:-

  • The tank is no more than 3500 litres in capacity
  • Is no more than 3m above ground level
  • Is no nearer to the 'highway' than any part of the 'original building', or 20m whichever is the nearer. [See Extensions]

Bulk tanks may also require careful location for health and safety reasons. You should always use reputable installation companies or consult with the Council if you are unsure.
