BADGERS
Anyone
contemplation development needs to be aware that planning authorities are
required to take account of protected species and habitat conservation when they
consider planning applications. The Government has issued Planning Policy
Guidance in PPG.9: Nature Conservation, which explains the role of planners in
protecting wildlife and the requirements of wildlife legislation.
The
Badger is a protected species and is specifically protected under The
Protection of Badgers Act 1992. It is an offence to:
A
badger sett is defined by the legislation as "any structure or place
which displays signs indicating current use by a badger". This is
taken by English Nature to include seasonally occupied setts.
English
Nature is the licencing authority for sett interference or disturbance to
badgers within setts that might result from land development.
A
licence must be obtained from English Nature before any development works commence
that might affect a badger sett. Licences cannot be issued retrospectively.
A licence application must be made at least one month before any proposed works
commence but good practice indicates that English Nature should be contacted at
an early date to establish their requirements.
