HOW LONG DO I HAVE?

For any planning applications made on or after 5^th September 2003 in England up to the 17^th January 2005 you have three months* from the date of the planning application decision notice, or 3 months of the date by which the Council should have decided the application, within which to lodge an appeal. For planning applications lodged prior to 5^th September 2003 the original six month period remains applicable.

* The Government have recently rescinded this change and reverted to a 6 month period for all applications lodged on or after the 14^th October 2004. This is reputed to be a permanent change.

For Listed Building Appeals the appeal and all the supporting documents must also now be submitted within 6 months from the date of receipt of the notice of the Local Planning Authority’s (LPA) decision or within 6 months of the date by which they should have decided the application.

A similar provision was to have been introduced in Wales in 2004.
