PLANNING APPEALS

HOW LONG DO I HAVE?

 For any planning applications made on or after 5th September 2003 in England up to the 17th January 2005 you have three months* from the date of the planning application decision notice, or 3 months of the date by which the Council should have decided the application, within which to lodge an appeal. For planning applications lodged prior to 5th September 2003 the original six month period remains applicable.

* The Government have recently rescinded this change and reverted to a 6 month period for all applications lodged on or after the 14th October 2004. This is reputed to be a permanent change.

For Listed Building Appeals the appeal and all the supporting documents must also now be submitted within 6 months from the date of receipt of the notice of the Local Planning Authority’s (LPA) decision or within 6 months of the date by which they should have decided the application.

A similar provision was to have been introduced in Wales in 2004.
